Knit Notes Terms & Conditions of Sale

These Terms and Conditions (“Terms”) govern your use of the Knit Notes website at [website URL] (“Site”) and the purchase of products from Knit Notes (“we”, “us”, “our”). By placing an order or using our Site, you agree to these Terms in full. Please read them carefully before purchasing.

These Terms apply to customers in New Zealand and Australia, and have been prepared to comply with the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), and other applicable consumer protection legislation.

1. About Us

Knit Notes is a product owned and operated by Department of Public Consumption Ltd., a New Zealand-registered company. Department of Public Consumption Ltd. sells knitting planners, binders, and related stationery products under the Knit Notes brand selling knitting planners, binders, and related stationery products. 2. Orders & Order Acceptance

2.1 Placing an Order

By submitting an order through our Site, you are making an offer to purchase the selected products. We reserve the right to accept or decline any order at our discretion.

2.2 Order Confirmation

A confirmation email sent to you after checkout constitutes our acceptance of your order and forms a binding contract. Please check this email carefully and notify us immediately if any details are incorrect.

2.3 Order Changes & Cancellations

We process orders quickly. If you need to change or cancel an order, please contact us at hello@knitnotes.co.nz as soon as possible. We will do our best to accommodate requests made before dispatch, but we cannot guarantee changes or cancellations once an order has been dispatched.

2.4 Stock Availability

All orders are subject to product availability. If an item becomes unavailable after your order is placed, we will notify you promptly and offer a full refund, alternative product, or backorder arrangement as appropriate.

3. Pricing & Payment

3.1 Pricing

All prices displayed on our Site are in New Zealand Dollars (NZD) and include GST (Goods and Services Tax at the current rate of 15%) as required under New Zealand law. We reserve the right to change prices at any time without notice, but price changes will not affect orders already confirmed.

3.2 GST for Australian Customers

Australian customers may see prices in NZD. NZ GST is not charged to international customers; however, Australian customers may be liable for Goods and Services Tax under Australian law where applicable. We are not responsible for calculating or collecting Australian GST on your behalf.

3.3 Payment Methods

We accept the following payment methods:

•       Visa and Mastercard credit and debit cards

•       PayPal

•       Buy Now Pay Later services

By submitting payment, you confirm that you are authorised to use the payment method provided.

3.4 Pricing Errors

In the event of a pricing error on our Site, we reserve the right to cancel an order and issue a full refund, or to contact you to confirm the correct price before proceeding. We are not obligated to fulfil orders placed at an incorrect price.

4. Shipping & Delivery

4.1 Dispatch Times

We aim to dispatch all orders within 1–3 business days of payment confirmation. Business days exclude weekends and New Zealand public holidays.

4.2 Delivery Timeframes

•       New Zealand: Estimated 2–4 business days after dispatch

•       Australia: Estimated 7–14 business days after dispatch

•       Rest of world: Estimated 7–21 business days after dispatch

These are estimates only. We are not liable for delays caused by our delivery partners, adverse weather, or events outside our control.

4.3 Shipping Costs

Shipping costs are calculated at checkout based on your delivery location and the weight of your order. Shipping costs are non-refundable except where required by applicable consumer law.

4.4 International Shipping — Customs & Duties

International customers (including those in Australia) are responsible for any customs duties, import taxes, or local charges imposed by their country. Knit Notes has no control over these charges and is not responsible for them. If you are unsure about applicable duties, please check with your local customs authority before ordering.

4.5 Order Tracking

Once your order is dispatched, you will receive a confirmation email containing your tracking number. You can use this to track your parcel via our delivery partner’s tracking page.

4.6 Undeliverable Parcels

If a parcel is returned to us as undeliverable due to an incorrect or incomplete address provided by you, we reserve the right to charge a re-delivery fee. Please ensure your shipping address is correct at the time of ordering.

5. Returns, Refunds & Exchanges

5.1 Consumer Guarantees — New Zealand

Under the New Zealand Consumer Guarantees Act 1993, our products come with guarantees that cannot be excluded. You are entitled to a repair, replacement, or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time.

5.2 Consumer Guarantees — Australia

Under the Australian Consumer Law, our products come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

5.3 Change of Mind Returns

In addition to your statutory rights, we accept change of mind returns within 30 days of the date of purchase, provided:

•       The item is unused and in its original condition

•       The item is in its original packaging

•       You contact us at returns@knitnotes.co.nz with your order number and reason for return before sending

Return shipping costs for change of mind returns are the responsibility of the customer. We recommend using a tracked service as we cannot accept responsibility for items lost in transit to us.

5.4 Faulty, Damaged or Incorrect Items

If your order arrives damaged, faulty, or is not what you ordered, please contact us at returns@knitnotes.co.nz within 7 days of receiving your order. Please include:

•       Your order number

•       A description of the issue

•       Photo(s) of the damaged or incorrect item and packaging

We will arrange a replacement or full refund at no cost to you, including return shipping where applicable.

5.5 Sale & Discounted Items

Items purchased at a sale price are final sale and are not eligible for change of mind returns or exchanges. Your statutory consumer rights under the Consumer Guarantees Act (NZ) and Australian Consumer Law remain unaffected and apply regardless of whether an item was purchased at full or reduced price.

Full-priced items purchased using a promotional or discount code are treated as regular purchases and fall under our standard 30-day return policy.

5.6 Refund Processing

Once we receive and inspect your returned item, we will notify you of the outcome. Approved refunds will be processed to your original payment method within 14 business days of us receiving the return.

6. Products

6.1 Product Descriptions

We make every effort to accurately describe and display our products. However, we do not warrant that product descriptions, images, or other content on the Site are completely accurate, current, or free from errors. Colours may vary slightly due to monitor settings or print variations.

6.2 Product Use

Our planners and stationery products are designed for personal, non-commercial use. Knit Notes products are suitable for both knitters and crocheters for project tracking, yarn stash management, and related creative record-keeping.

6.3 No Refillable Inserts

Our current planners are self-contained products and are not designed as refillable binder systems. No separate inserts are required or available unless otherwise stated on the product page.

7. Gift Cards

Knit Notes gift cards are issued digitally and are valid for [insert validity period, e.g. 36 months] from the date of purchase. Gift cards:

•       Are redeemable for products on the Knit Notes website only

•       Cannot be exchanged for cash

•       Cannot be replaced if lost, stolen, or used without your consent

•       Are non-refundable except as required by applicable consumer law

Under Australian and New Zealand consumer law, gift cards must not expire within three years of purchase. We comply with these requirements.

8. Intellectual Property

All content on this Site, including but not limited to product designs, text, graphics, logos, photography, and the Knit Notes brand, is the property of Department of Public Consumption Ltd (trading as Knit Notes) and is protected by New Zealand and international copyright and intellectual property laws.

The name “Knit Notes” and associated logos and branding are trademarks of Department of Public Consumption Ltd. Unauthorised use of these trademarks is strictly prohibited.

You may not reproduce, distribute, modify, or use any content from this Site for commercial purposes without our prior written consent. This includes, but is not limited to, copying product designs, reproducing planner layouts, or imitating the Knit Notes brand in any form.

9. Privacy & Personal Information

We collect and hold personal information in accordance with our Privacy Policy, available at [link to Privacy Policy]. By using our Site and placing orders, you consent to the collection and use of your personal information as described in our Privacy Policy.

We comply with the New Zealand Privacy Act 2020 and, where applicable to Australian customers, the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We do not sell or rent your personal information to third parties.

10. Limitation of Liability

To the maximum extent permitted by applicable law (including the Consumer Guarantees Act 1993 (NZ) and the Australian Consumer Law), Knit Notes’ liability for any claim arising from the use of our Site or the purchase of our products is limited to:

•       The replacement or repair of the goods; or

•       The cost of having the goods repaired or replaced; or

•       A refund of the purchase price paid.

We exclude all liability for indirect, incidental, special, or consequential loss or damage to the extent permitted by law, including but not limited to loss of profits, loss of data, or business interruption.

Nothing in these Terms limits or excludes any consumer guarantee, right, or remedy that cannot lawfully be excluded or restricted under applicable New Zealand or Australian consumer law.

11. Disclaimers

Our Site is provided on an “as is” basis. We do not warrant that the Site will be available at all times, free from errors or viruses, or that defects will be corrected. We are not liable for any loss or damage arising from your use of, or inability to use, the Site.

Links to third-party websites are provided for convenience only. We do not endorse or take responsibility for the content or practices of any third-party site.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of New Zealand. Any dispute arising in connection with these Terms or your purchase will first be referred to us for resolution by contacting hello@knitnotes.co.nz. We are committed to resolving complaints promptly and fairly.

For customers in Australia, nothing in these Terms limits your rights under the Australian Consumer Law. Unresolved disputes may be referred to the relevant consumer protection authority, including Consumer Affairs in your state or territory, or the Commerce Commission (New Zealand).

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. The current version will always be published on our Site with the effective date noted at the top of this document. Continued use of our Site or purchase of our products after changes are posted constitutes your acceptance of the updated Terms.
